The following terms and conditions are established between the French company CEG on one hand:

Named as “us” or “CEG” or “Walkonwaterstore.com” on the other hand, the persons wanting to make a purchase via the Internet site www.walkonwaterstore.com named “you” or “customer”.

The parties agree that their relationship is ruled by this contract, with exclusion of any other pre-existing conditions available on the website.

If a condition would not be mentioned, it would be ruled by the current conditions in force within the industry of online sales for companies having their head office located in France.


ARTICLE 1 : SCOPE OF WORK

The following conditions defined the modalities of sales between www.walkonwaterstore.com and its customers, from the order to the delivery.
It defines all the necessary steps from the reception to the follow-up of the order.

These conditions only apply to individuals, not a business and aged 18 years of age and over with the juridical capacity to respect this contract.


ARTICLE 2 : THE ORDER

The customer has the possibility to place an online order:

-    Or directly by mail to the CEG head office / www.walkonwaterstore.com

An order cannot be taking into account if the user has been clearly identified by his/her login and password, which as strictly personal.

Any order implies acceptation of the the price, and/or discription of the products available for sales.

CEG / www.walkonwatersore.com shall honour any order received via its internet website only to the limit of its available stock. Failing to have a product available, we shall inform the customer, whom shall have the right to cancel his/her order.

Information available when placing the order, the price, the guarantees, and the payment mode are defined by the articles below.

ARTICLE 3 : PRODUCT AVAILABILITY

Delivery time are given in working days, may be modified depending on the delivery method selected, pending any case of force majeure, strike, company/supplier or third-party lock-out, or more generally, any situation beyond our control.

The delivery time depends upon the announced stock availability at the reception of the payment, meaning:
- From validation and reception of your order for a payment via credit card.

Stock information are clearly visible on each products:

-    IN STOCK for articles available, and eligible for an immediate delivery from 3 to 7 days depending on the country of final destination.
-    BACK ORDER for articles not available, but eligible for an immediate delivery from 3 to 7 days depending on the country of final destination, once the product is back in stock.

Shipment is organised when all the products ordered are available.

Our customer service is available to inform you about the state of your order and shall apply strictly order that you place with him/her: You have at anytime, the possibility to cancel part or entirely any non-sent order.


ARTICLE 4 : PRICING

Price are in EURO inclusive of French VAT applicable on the day of purchase with costs associated to the delivery, which depends upon the total weight of your order and the chosen delivery method.

Any change of VAT shall modify the price of the product.


ARTICLE 5 : PAYMENT

Payment are made by CEG / Walkonwaterstore.com from the moment you place your order, and regardless of the announced delivery time.

Customer may pay by credit cards, you are directly dealing with our bank (BNP Paribas France) on your secured SSL server, (Guaranteed confidentiality using the latest encryption technology) provided by our renowned partner OGONE.

In case of reimbursement, your credit card will be credited automatically.
Your order is treated immediately pending stock availability.

CEG / Walkonwaterstore.com reserved itself the right to refuse to organise a delivery or to honour an order coming from a customer who has not paid in full or partially the previous order, with which a litigation is underway.


ARTICLE 6 : DELIVERY

Shipping costs are calculated at the end of the order, applying the following rules:

-    For any order under 35 EUR, a flat delivery rate of 16 EUR shall apply
-    For any order above 35 EUR and below 65 EUR, a flat delivery rate of 9 EUR shall apply
-    For any order above 65 EUR, your order shall be shipped free of charge

An additional charge shall apply for destinations requiring customs charges.

Parcel shall be sent via our current transport company, i.e., TNT Express, from the day of expedition up until a maximum weight of 30kg.

Before the delivery, our customer service remains at your disposal, should you require any further information regarding the progress of your shipment.

After delivery, our customer service remains at your disposal, for any additional information regarding your parcel, and shall do its best to follow the parcel, or to put you in touch with the transport company for the delivery of your parcel.


ARTICLE 7 : RESPONSIBILITY

CEG cannot be hold responsible in case of delays occurred due to strike or failure from our transport company to delivery on time.

The choice and purchase are placed under the sole responsibility of the customer.

The total or partial impossibility to use the purchased products shall not be a case for financial compensation, nor reimbursement, nor generate any responsibility by CEG / www.walkonwaterstore.com for conform or not conform use of the product.


ARTICLE 8 : RETRACTION

In compliance with the ARTICLE L.120-20 and according to the French consumption code, you are allowed to 7 days retraction clause from the date of the reception of the goods without having to justify your decision, not to pay any penalties, except when applicable the cost of returning the goods to us.

Any item intentionally damaged shall not be accepted, not exchanged.


ARTICLE 9 : RIGHT TO RETURN THE GOODS

Upon reception of the goods, you have the possibility to express reserves on the quality of the transportation. Any parcel damaged during transportation shall be refused upon its arrival, in order, to start a return to sender procedure. This procedure shall not occur any charge at your end.

Should you receive a faulty or damaged product, please be so kind as to return to us indicating the reasons of this return, as well as, your purchase order number to the following address:

Unless prior commercial agreement, we shall not reimburse any shipment costs occurred to return the goods.


ARTICLE 10 : GUARANTIES

In order to avoid any disagreements, all items are checked by CEG before expeditions. However, all customers enjoy a contractual guarantee against any default the product could have for a month from the day of delivery.

To exercise this right, customer shall send the faulty product back to CEG / ww.walkonwaterstore.com at his own costs, along with the original invoice. A identical product shall be sent to you at our cost, unless the product is no longer available or has been removed from the range offered by www.walkonwaterstore.com. In this case, CEG / www.walkonwater.com shall reimburse the cost of the product.

In accordance with the ARTICLE 1641 of the French civil code, you enjoy also a legal guarantee for any hidden default. Only products, for which a hidden default has been established, shall be able to be returned. According to this article, customers shall declare the product to have a hidden default and shall prove it. An expertise shall be requested from the customer to a mandated expert, in order to establish this hidden default.

Should a hidden default be established, the official documentation shall be sent to our customer service without delays. Upon reception, a return procedure shall be started by our services. Return charges shall be at our charge. Acceptation of this charge shall be confirmed once the examination of the goods has been done by our services. Once the product return and accepted by our services, the faulty product shall be reimbursed at purchase price.

Upon acceptation of the hidden default by our services, the cost of the expertise may be reimbursed by our services, by sending us the corresponding invoice.


ARTICLE 11 : APPLICABLE LAW

All clauses appearing in these terms and conditions, as well as, all purchase and sales operations are according for the French law.


ARTICLE 12 : PERSONAL DATA

We guarantee to protect all your personal datas. All collected datas are treated with the strictest confidentiality.

ARTICLE 14 : LITIGATION

The following commercial contract is made under French law regardless of the situation. In case of litigation or failing to find a suitable solution between the parties, the express competencies is given to the court of law falling under the jurisdiction where the head office of CEG is located. This for whatever circumstances, whether it is call for guarantee, several defenders, even for emergency procedures, conservatory referred procedures or by request.
